The legal hold and data preservation processes are actually two different actions used together to ensure that data is not altered or destroyed when a party has the reasonable expectation that they will be sued. The legal hold is a formal communication to custodians of data requesting that they preserve any electronically stored information (ESI) relating to a lawsuit or possible lawsuit. Failure to properly issue and manage the legal hold and preserve data could result in spoliation of evidence (whether intentional or accidental) and could have serious consequences for the offending party.
